1. Introduction

These Terms of Use are used by Charmy (hereinafter referred to as "Charmy", "application", "platform", "portal", "we" or "our") to users who use the Services (hereinafter "User (s)") It was created to regulate the use and access of the platform.

If users use Charmy in any way, create an account or use the platform, the terms of use in this text will be accepted. For this reason, we remind you that Users should carefully review the Terms of Use, if they do not agree, they should not use Charmy or register with Charmy.

Charmy has the right to change these Terms of Use at any time and in any way. Related changes will become effective when they are published on the platform.

2. Definitions

• Agreement: means the program and annexes of this agreement between the Company and the User and any agreement attached or referenced.
• Applicable Legislation: refers to all relevant laws and regulations and other obligations.
• Confidential Information: verbally, in writing, in machine-readable form or regarding the Company's business, equipment, services, developments, trade secrets, know-how, personnel, suppliers and customers means all information obtained.
• Content: collection of text, graphics, photographs, video and/or audio material, software, database and other information, data and materials provided by Charmy or compiled on the platform by the User.
• Intellectual Property Rights: developed, including any software, tool, feature, description, document, report, diagnostic test, report, data or other development work, results of Content, all Intellectual Property Rights created or developed by Charmy.
• Services: means the content that the Company will make available to Users in accordance with the services to be provided under these Terms.
• User: means persons who have the right to use the Services or access the Portal.

3. Services

Charmy offers its users a platform with the capabilities of preparing lists in their own areas of interest, sharing them individually or in a list, sending posts, personal messaging and receiving suggestions with artificial intelligence assistants, with content in specified categories.

4. Rights and Obligations

1. 1. In order to create an account on Charmy, Users must specify their e-mail addresses and a password. The password to be created for the account is entirely under the responsibility of the Users. Illegal or unauthorized account creation is prohibited.
2. 2. In case of creating an account in Charmy, the relevant accounts will be available unless they are terminated by the User (except in cases against the rules or the law). The User is responsible for the accuracy of the information provided while creating the account.
3. 3. Users must be over the age of 13 in order to use Charmy or create an account on Charmy. Charmy will not be liable for any disputes that may arise from the use of persons under the age of 13.
4. 4. Users are obliged to use Charmy for the purpose of development. The platform provided by Charmy must be used in accordance with the law and the purpose of the platform.
5. 5. No action will be taken to harm Charmy or to disrupt the quality of the application; The User declares and undertakes that the platform will not be used other than the ways offered by Charmy.
6. 6. The User accepts and undertakes that the responsibility arising from the actions contrary to the laws, rules, related regulations, moral or goodwill rules will belong to the User.
7. 7. The user acknowledges and agrees that he/she will be held responsible for the comments he/she will make, the content to be shared, and the communication with the persons. If an illegal behavior is detected, the account of the relevant User may be terminated by Charmy.
8. 8. Charmy will be able to offer you paid content. The purchases to be made can be made in different ways and at different prices depending on the service scope of the payment institution intermediaries.
9. 9. All credit card and approval transactions regarding paid content in Charmy are carried out by the relevant bank or card institutions, and Charmy does not have any intervention in this process.
10. 10. Accounts created by users are intended for personal use. Users should not share their accounts with others.
11. 11. It is possible for users to create personal content on Charmy. The User declares and undertakes that the personal content produced does not violate the rights of third parties in any way.
12. 12. The User may not perform, cause or allow others to modify any part of the Services, derivative work, decompile, compile, reverse engineer, reproduce, republish or copy.
13. 13. Regarding the content created on the platform, Charmy is deemed to have undertaken to license Charmy for hosting, storing, using, distributing, operating, copying, translating and showing the content to others.
14. 14. Regular improvements and updates will be made in order for Charmy to provide better service or to be a safer platform.
15. 15. The platform is a software/application developed by Charmy and all rights belong to Charmy.
16. 16. During the usage of Charmy by the Users, access to some features of the devices may be allowed.
17. 17. Charmy offers the platform it has developed without any commitment to the Users and does not have any responsibility for any problems that may occur.
18. 18. In other sites or applications accessed via Charmy, the terms of use, security policies, communication and personal data processing terms of those platforms will be valid.

5. General Provisions

• These terms of service are subject to Turkish Law, and Turkish Law will be taken as basis for their application and interpretation.
• If any or more of the terms of use are invalid, void, illegal or canceled, it will not affect the validity, legality, enforceability and enforceability of the remaining clauses and provisions.
• Under these terms, Users acknowledge and declare that Charmy reserves the right to transfer or assign their rights or obligations to another party.
